Terms of Service

By accessing or using the Truffl platform, website, APIs, or any related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not use our Services.

“Truffl”, “we”, “us”, “our” means I-TECH INFONET PVT LTD, registered in India, operating the Truffl brand.

“Customer”, “you” means any person or organisation that accesses or uses the Services.

“Platform” means the Truffl software platform accessible at trufflinnovations.in and related sub-domains.

“Voice Workflow” means any AI-driven voice interaction configured and deployed through the Platform.

“Customer Data” means any data, recordings, transcripts, or content that you submit to or generate through the Platform.

“End Customer” means any individual who receives or is subject to a Voice Workflow you deploy.

Truffl provides a Voice Operating System — a platform for configuring, deploying, and managing AI voice agents for business workflows. Services include workflow configuration, telephony integration, AI model routing, call quality evaluation, analytics, and post-call intelligence generation.

Truffl is not a licensed telecom operator. We use licensed third-party telephony and communication providers to route calls. The availability and quality of call delivery depends on these providers.

We reserve the right to modify, update, or discontinue any feature or component of the Services at any time with reasonable notice where practicable.

To use the Platform, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You must notify us immediately at hello@trufflinnovations.in if you become aware of any unauthorised use of your account.

You may not share your account credentials with third parties, create accounts on behalf of others without authorisation, or use automated tools to create accounts.

You agree to use the Services only for lawful purposes and in accordance with our Acceptable Use Policy. You must not:

• Deploy voice workflows for deceptive, harassing, or fraudulent communication
• Call individuals without appropriate consent or in violation of applicable law (including TRAI regulations)
• Use the platform to process data of children under 18 without appropriate safeguards
• Attempt to reverse-engineer, scrape, or interfere with the Platform
• Resell or sublicense the Services without our written consent
• Use the Services in a way that violates the rights of any third party
• Circumvent any security, access, or usage limitations of the Platform

We reserve the right to suspend or terminate access to the Services if we determine, in our sole discretion, that your use violates these terms or applicable law.

You retain ownership of all Customer Data you submit to or generate through the Platform. By using the Services, you grant us a limited, non-exclusive licence to process Customer Data solely to provide and improve the Services.

You are responsible for ensuring that Customer Data you submit complies with applicable law, including data protection and privacy regulations. You represent that you have the right to submit such data to the Platform.

We process Customer Data in accordance with our Privacy Policy and, where applicable, a Data Processing Agreement.

You are solely responsible for the content, configuration, and compliance of any Voice Workflow you deploy through the Platform. This includes:

• Ensuring you have the appropriate consent to contact End Customers
• Complying with call recording disclosure requirements under applicable law
• Configuring appropriate escalation to human agents where required
• Ensuring your workflows do not violate applicable telecom regulations (including TRAI DND and TCPA equivalents)
• Managing the accuracy and appropriateness of AI responses in your configured workflows

Truffl provides tooling and documentation to help you configure compliant workflows, but does not guarantee legal compliance of your specific deployment. You should seek independent legal advice for regulated sectors.

Fees for the Services are described in your selected plan or as agreed in a separate commercial agreement. All fees are exclusive of applicable taxes (including GST) unless stated otherwise.

Payment is due in advance for subscription plans and upon invoice for enterprise arrangements. We reserve the right to suspend Services for non-payment after reasonable notice.

All fees paid are non-refundable except as required by applicable law or as expressly stated in a commercial agreement.

We reserve the right to change pricing with reasonable notice. Continued use of the Services after a price change constitutes acceptance of the new pricing.

All intellectual property rights in the Truffl Platform, software, documentation, and related materials remain the exclusive property of I-TECH INFONET PVT LTD. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for the purposes described in these Terms.

You may not copy, modify, distribute, sell, or create derivative works based on the Platform without our prior written consent.

If you provide feedback or suggestions about the Services, you grant us a perpetual, irrevocable, royalty-free licence to use such feedback for any purpose.

Each party agrees to keep confidential any non-public information disclosed by the other party that is identified as confidential or that a reasonable person would understand to be confidential given the context of disclosure.

This obligation does not apply to information that: (a) is or becomes publicly known through no fault of the receiving party; (b) was already known to the receiving party; (c) is independently developed by the receiving party; or (d) is required to be disclosed by law or court order.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or completely secure. AI-generated voice outputs may contain errors or be inappropriate for some contexts. You are responsible for reviewing and validating AI outputs before deployment.

We do not guarantee specific call delivery rates, connection rates, or business outcomes from the use of our platform.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUFFL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY YOU TO TRUFFL IN THE THREE MONTHS PRECEDING THE CLAIM; OR (B) INR 10,000.

Some jurisdictions do not allow certain limitations of liability. In such cases, the limitations above apply to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless Truffl and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: (a) your use of the Services; (b) your Voice Workflows and their impact on End Customers; (c) your violation of these Terms; (d) your violation of any applicable law; or (e) any claim by a third party relating to your use of the Platform.

Either party may terminate these Terms with reasonable notice. We may suspend or terminate your access immediately if we determine that you have materially violated these Terms or applicable law, or if continued service poses a risk to other customers or third parties.

Upon termination, your right to use the Services ceases immediately. We will make Customer Data available for export for a reasonable period following termination, after which it may be deleted in accordance with our data retention policies.

Provisions of these Terms that by their nature should survive termination (including intellectual property, confidentiality, indemnification, and limitations of liability) will survive.

We may modify, suspend, or discontinue any part of the Services at any time. We will provide reasonable advance notice of material changes where practicable. Your continued use of the Services after changes take effect constitutes acceptance of the modified terms.

The Platform integrates with third-party services including telephony providers, AI model providers, CRM systems, and payment processors. Use of these services is subject to their respective terms and privacy policies. Truffl is not responsible for the availability, performance, or practices of third-party services.

If a third-party provider changes its terms, discontinues a service, or experiences an outage, this may affect the functionality of the Truffl Platform. We will make reasonable efforts to notify you of material changes and identify alternatives where possible.

The Truffl Platform uses AI language models and speech processing models to power voice workflows. AI outputs are probabilistic and may contain errors, inaccuracies, or unexpected responses. You are responsible for reviewing AI configurations and ensuring that deployed workflows meet your quality standards before going live with End Customers.

By default, Truffl does not use your Customer Data to train AI models. Where you configure the platform to use specific AI providers, those providers’ usage terms apply to the data sent to their APIs.

These Terms are governed by the laws of India. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Rajkot, Gujarat, India.

Before initiating formal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days following written notice of the dispute.

Entire agreement. These Terms constitute the entire agreement between you and Truffl with respect to the Services and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.

Notices. Notices to Truffl must be sent to legal@trufflinnovations.in. We may send notices to you via the email associated with your account.
